Ananthi delivers another UNHRC address on genocide investigation

“We request this assembly to call for international investigation on genocide, and as an immediate step, to come out with a mechanism to stop the on-going genocide of Eelam Tamils,” Ms Ananthi Sasitharan told the UN Human Rights Concil at Geneva, delivering a second address under the General Debate on Friday. The resolutions passed in the recent years and the draft resolution to be submitted this year have disappointed the Tamils as these resolutions have failed to address the main problems of the victims, she told the Council. As an immediate step, she urged the international community to come out with a mechanism to stop the on-going genocide of Eelam Tamils.

“We sense a lack of political will, as an investigation on the genocide has not been called for, by the OHCHR and the UN system in general,” she told the UNHRC while welcoming the call by the High Commissioner to this assembly to appoint a Commission of Inquiry on Sri Lanka.

Full text of her oral statement follows:

Thank you Chair,

We welcome the annual report of the UN High Commissioner for Human Rights.

We recognize the special role played by the High Commissioner Ms Navanetham Pillay.

Today, I stand before this assembly, representing the NGO VSSU, and also as an elected representative of the Tamil National Alliance in the Northern Provincial Council from the island of Sri Lanka.

Five years have gone after the end of war in the island. The homeland of the Tamil people in the North and East of the island is now occupied by a genocidal military.

We are very disappointed with the resolutions, passed by this assembly in 2012 and 2013. The new draft resolution, to be submitted to this session, has also disappointed us a lot.

Our main problems are not addressed by these resolutions.

The root problem is the 60-year-old genocide against our people.

This genocide is still going on without a war. We call it a structural genocide.

The annual report has correctly identified the lack of a political will on the part of Sri Lankan system to conduct domestic investigations.

In addition, the Sri Lankan State is committing the crime of Genocide-Denial.

How can we expect the Sri Lankan State to conduct credible and independent investigation?

We welcome the call by the High Commissioner to this assembly to appoint a Commission of Inquiry on Sri Lanka.

But, as victims, we sense a lack of political will as an investigation on the genocide has not been called for by the OHCHR and the UN system in general.

We request this assembly to call for international investigation on genocide – and as an immediate step – to come out with a mechanism to stop the on-going genocide of Eelam Tamils.

Ms Ananthi Sasitharan, the popular TNA councillor of the Northern Provincial Council (NPC) on Friday addressed the United Nations Human Rights Council's 25th session taking place in Geneva. She requested the UN system to take “bold steps in understanding the 60-year-long genocide and investigate it through an independent international investigation.” Addressing the UNHRCs General Debate, the 47-year-old mother of three told the Council that the children affected in any war spend a lifetime to recover from the impact. “But, the Eelam Tamil children face a continued war with genocidal intent,” she said urging “concrete actions to safeguard our children from becoming permanent victims to the genocide.”

“As I speak here today, the Sri Lankan Army has arrested a 13-year-old girl, Vipooshika Balendran, who comes to every protest, crying and seeking to free her brother. Her arrest is as an open threat against every child protesting injustices,” Ms Ananthi told the Council.

The children affected in any war spend a lifetime to recover from the impact. But, the Eelam Tamil children face a continued war with genocidal intent.

I am here today, not only as a voice of an NGO. But, also as a mother of three daughters, who are still searching for their father.

My husband, Elilan, was a political leader. He surrendered to the Sri Lanka Army in front of our own eyes, at the end of the war. Five years have gone. The Sri Lankan government has no answer to our questions. There are thousands of children, like mine, searching for their loved ones.

As I speak here today, the Sri Lankan Army has arrested a 13-year-old girl, Vipooshika Balendran, who comes to every protest, crying and seeking to free her brother. Her arrest is as an open threat against every child protesting injustices.

The occupying military, carrying weapons, is controlling every aspect of our civil lives. There is 1 soldier per 5 civilians. They are stationed around houses and schools.

The military is accused of sexual violence on Tamil women and children. The children are also forced to work. Military persons are also being appointed as teachers in the schools.

In the world of our children, the Armed Conflict is still there as before.

I urge the Council to take bold steps in understanding the 60-year-long genocide and investigate it through an independent international investigation.

We seek concrete actions to safeguard our children from becoming permanent victims to the genocide. We do not want our children to end up as a lost generation.

Ms Sasitharan was addressing the Council representing the Belgium-based Collectif des Femmes Africaines du Hainaut (CFAH).

Ms Sasitharan personally witnessed Sri Lanka military taking away her husband, Mr Elilan, a political leader of the LTTE, at the end the Vanni War in May 2009.

Before leaving for Geneva, Ms Ananthi held a press conference in Jaffna, where she said that the international community had deceived the genocide affected Tamils on delivering international investigations.

“The draft resolution being circulated in Geneva has failed to satisfy even the minimum expectations. It has totally disregarded the repeated requests from Tamils to the IC to deliver international investigations,” she told the press in Jaffna blaming the TNA national list parliamentarian M.A. Sumanthiran for having instructed her to be silent at a crucial meeting with the representatives of 18 countries during her visit to Geneva last month.

Deploying hundreds of soldiers after detaining a 48-year-old mother and her 13-year-old daughter on Thursday, the Sri Lankan military has rounded up the village of Tharmapuram in Ki'linochchi, cutting off the contact between the village and the outside world, news sources in Ki'linochchi said. The SL military is attempting to create a scene of ‘LTTE regrouping’ through its intelligence operations to support its propaganda in Geneva, sources close to the Tamil National Alliance (TNA) in Ki'linochchi said.

The detained girl and her mother have been taken to an undisclosed location. They are not reachable through mobile phone, their relatives said Friday morning.

The General Secretary of Tamil National Alliance (TNA) Maavai Senathirajah, TNA MP E. Saravanapavan and a group of Northern Provincial Council members have gone to Ki'linochchi from Jaffna Friday morning trying to contact the affected family.

The occupying Sri Lankan military in Ki'linochchi has arrested a 13-year-old girl and her 48-year-old mother, sending shock waves across the entire Tamil nation on Thursday. The girl, Vipooshika Balendren has become a symbol of young children seeking the whereabouts of their family members, as she used to attend the peaceful protests crying in search for her brother, touching the hearts of the people. In a move, believed to be a trap to target the girl and her mother, more than 350 Sri Lankan soldiers rounded up their village Thursday evening in an encounter like operation claiming that they were looking for a ‘terrorist’. The SL military is detaining the girl and her mother, Jeyakkumari Balendran, news sources in Ki'linochchi told TamilNet Thursday night.



On 15 November 2013, when the British Prime Minister David Cameron came to Jaffna, the girl and her mother were taking part in a protest. The girl was also crying when UN High Commissioner for Human Rights Navi Pillay visited Jaffna.



The and13-year-old Vipooshika and her mother have been taking part in several peaceful protests, crying and demanding the whereabouts of the missing persons.

According to initial reports from Ki'linochchi, the SL military has been searching for a person who was a driver. The person was staying in the village and was seen running to escape from the SL military.

The SL military has also fired at the house of the 13-year-old girl.

The villagers say that the person could have planted to set up a scene to arrest the girl and her mother.

The New Delhi Establishment’s Foreign Minister, Mr. Salman Khurshid, in answering a question after his address at the SOAS in London on Wednesday, said, “Tamils should have a dialogue with the government. Then only we can have a leverage on Sri Lankan government.” With a record on complicity in Colombo’s genocidal war and on-going structural genocide of Eezham Tamils; record on tilting the balance in favour of Colombo, and with a long record on setting diktats to the Tamil leadership on what to talk, New Delhi now expecting Tamils to start ‘dialogue’ is for the confirmation of the genocide and for bailing out Colombo from international investigations, Tamil activists in London commented.

When New Delhi is not prepared to accept the nation and territoriality of Eezham Tamils; the genocide committed and being committed against them and their right to self-determination, what New Delhi is expecting in a dialogue between parties deliberately kept unequal is apparent, the activists observed.

Mr. Salman Khurshid’s timing of advocating Tamils to start dialogue with Colombo having long-standing genocidal orientation, and showing no will for amendment, is primarily for the evasion of any international investigation, by citing the ‘dialogue’ and making use of the time and space provided by the current US resolution, the activists in London said.

However, more than caring Salman Khurshid, Tamils have to be actually careful about their own political articulators – the ‘installed, nominated and the hijacked ones’ – who would fall a prey to designs giving foul leverage to New Delhi and its partner in Colombo, the activists further said.

V. Suryanarayan of New Delhi’s ‘national security’ connections wrote the following in New Indian Express last Wednesday:

“It was Indian insistence that finally led to provincial council elections. The unprecedented turnout and the landslide victory of the TNA convincingly proved that not only was the alliance the most representative organisation, it was also willing to work within the existing constitutional framework.”

“It goes to the credit of Wigneswaran and Sampanthan that even under these adverse circumstances, they have not given up hope of working together with the Sinhalese in a united Sri Lanka,” the Chennai-based ‘national security’ academic, known for several decades of his anti-Eelam views said.

The Oxford-educated lawyer, Mr. Salman Khurshid was delivering a lecture on “Challenges of Democracy in India,” at the South Asia Institute of the School of Oriental and African Studies (SOAS) in London.

The questions session of the address was virtually overtaken by questions on Kashmir raised by spirited audience at the lecture.

Even after the lecture, they surrounded the New Delhi External Affairs Minister with questions on seven decades of injustices committed to democracy and people of Kashmir, until New Delhi’s High Commission officials escorted the minister out.

There was only one question on Eezham Tamils that how long it would take for the Tamils to have a reasonable and dignified solution.

“We are working on it. Tamils should have a dialogue with the government. Then only we can have a leverage on Sri Lankan government,” Mr. Salman Khurshid replied.

The Eezham Tamil diaspora in UK is estimated to be around 300,000.

Inviting world public in the search for the missing MH370, a US firm, DigitalGlobe, has thrown open its data from five orbiting satellites. The resolution of the images would be to the extent of half a meter of ocean surface per computer screen. While this is a free service, termed as “crowdsourcing,” the firm’s data on a fee-basis was also open to the public on Ukraine violence and some natural disasters in the past month. The service is termed “First Look Event Service.” While some countries have such a capacity, their Establishments also have the capacity of coursing a genocidal war without witnesses and shielding it for five years, as in the case of Mu’l’livaaykkaal, Tamil political observers said.

The satellite images of the Gulf of Thailand would be made available for free to the public on a website called Tomnod, The Malaysian Insider reported on Tuesday, citing ABC News.

In November, the company launched a similar crowdsourcing campaign after Typhoon Haiyan devastated Southeast Asia and users, who placed more than 400,000 tags on images, helped identify 38,000 damaged buildings and 101,000 damaged homes.

DigitalGlobe runs a fee-based First Look Event Service that compares before-and-after images for clients.

In the past month, the company activated the service to observe wildfires in Australia, violence in Ukraine and the aftermath of ice storms in Atlanta, The Malaysian Insider further reported.

US draft ‘positive’ on many counts in making Tamils ‘learn lesson’

The US draft tabled at the UNHCR has to be recognized for its positive aspects in disguise that make Tamils learn historic lessons, commented Tamil activists for alternative politics in the island. The draft opens eyes on the ultimate culprits who actually led Eezham Tamils into Mu’l’livaaykkaal and continue to lead them into accepting structural genocide; on the extent of USA’s confidence in the inherent orientation for subservience and gullibility among Eezham Tamil ‘articulators’; and on the extent of the infiltration the USA has made into various facets of Tamil Nadu – from Brahministic media to ‘original’ Dravidian movements, and from ‘communism’ to various caste politics, the activists in the island said.

This time there was a strong orchestration in Tamil Nadu, supplemented by an array of ‘visitors’ from the diaspora, for not to raise any finger against the USA, but to press New Delhi to just fall in line with the US resolution.

Why such a political bankruptcy in Tamil Nadu, when the struggle has to primarily target the USA and press New Delhi to take independent steps in delivering justice to India’s backyard?

Whether you want a strong resolution coming and failing at the UNHRC, or you want ‘any’ resolution getting passed at the UNHRC to keep the island on the agenda of the UNHRC, seems to be Washington’s blackmail of Tamil articulators.

As a result, there is once again jubilance in the genocidal quarters of Colombo over the Sinhala State getting time and space for the irreversible completion of the genocide, which is once in a millennium opportunity for it.

One could believe in Washington’s inability at the UN [after all its abilities in mobilising the entire international community of Establishments when it was genocide], if Washington has so far done anything at least outside of the UN in the last five years to restore the balance of the nation of Eezham Tamils in the island.

In restoring the balance of Eezham Tamils, Washington on its own could have done many things outside of the UN or any other international forum, which could have been practically more powerful than bringing in resolutions. But the USA did nothing.

On the contrary, from the theoretical negation of the nation and territory of Eezham Tamils to non-recognition of the genocide and on-going genocide; and from continued ban and vilification of the LTTE to continued military, financial and logistical support to genocidal Colombo, the USA continues to tilt the balance in favour of the genocidal engineering in the island.

If any of the so-called Tamil ‘diplomats’ are going to continue defending the USA, citing its ‘genuine’ inabilities and the ‘virtues’ of whatever that is achieved through ‘any’ resolution, and are going to argue for a gullible approach towards the USA and UK, the global Tamils have to only pity at their Goebbelism coupled with Quislingism.

The simple truth is that the USA and UK don’t care for their own supporters among Tamils. They don’t even care about those supporters getting discredited. More than the demographic and worldwide strength of State-less Tamils, the ultimate culprits care and fear for the genocidal nation in the island, because it has State.

This underlines the need, why the nation of Eezham Tamils, especially in the context of the strategic island, should get its sovereign State. It is not only as a Right to Protection from the age-old genocide that is now accelerated, but also as a Right to Protection from the international vultures of today as well as tomorrow, hovering over the geostrategic island.

A genuinely or seemingly ignorant stand taken by many in the outside of the island is that Eezham Tamils were wrong and are wrong in asking for an independent State for them, and that the Eezham Tamils in the North and East don’t consider the future of the Tamils in the rest of the island.

They don’t understand that genocide of Eezham Tamils is a centuries old process in the island. An inalienable thinking in the Sinhala nation in the island is that why can’t the Tamils become Sinhalese and Buddhists, following a dominant historical process of the past in the island. Such a nation left with the control of the modern State will always work towards completion of the genocide either through war or lure.

Only an independent State for Eezham Tamils in one part of the island could stop the genocide, will bring in a balance that could not come in any other way in Sinhala psyche, will guarantee the status of other Tamil-speaking people in the rest of the island, and will pave way for genuine reconciliation.

When the realities are such, cutting almost a comic figure both in the nations of Sinhalese and Eezham Tamils, Professor V. Suryanarayan of New Delhi’s ‘national security’ connections came out with the following statement in the New Indian Express on Wednesday, while counting trees and lamenting on what the Sinhala polity is doing to Tamils.

“It goes to the credit of Wigneswaran and Sampanthan that even under these adverse circumstances, they have not given up hope of working together with the Sinhalese in a united Sri Lanka,” Suryanarayan wrote.

“It was Indian insistence that finally led to provincial council elections. The unprecedented turnout and the landslide victory of the TNA convincingly proved that not only was the alliance the most representative organisation, it was also willing to work within the existing constitutional framework,” Suryanarayan elaborated further.

When the crux of the interest in the ilk of him in India is united Sri Lanka and Tamils working under the existing constitutional frame work, all his wailings on what is taking place in the island and all what he is expecting from the Colombo government are comically absurd.

The Sinhala State will not change and Suryanarayans also will not change. This ilk and the main stream English media in India have done enough damage to Eezham Tamils for decades in shaping a misleading public opinion in India that ultimately has led to the genocide and is leading to the progress of the on-going structural genocide.

South Africa’s Desmond Tutu and 38 Human Rights activists and organisations have now called for the UNHRC to set up a Commission of Inquiry (CoI).

“We, concerned individuals and organizations from around the world, urge the UN Human Rights Council (UNHRC) to use their March 2014 session to pass a resolution that will include a commitment to an Independent International investigation in the form of a Commission of Inquiry,” the petition said.

Besides Tutu, Yasmin Sooka who was part of the UNSG report, Mr. C.V. Wigneswaran, Mr. R. Sampanthan and the Bishop of Mannaar were also signatories to the petition.

“Standing in solidarity with the many Sri Lankans who feel their government is making a mistake, we urge the United Nations to establish a Commission of Inquiry,” the petition concluded.

It is misleading to say that it is the Sri Lankan government that is making a mistake. It is the Sri Lankan State.

Indicting the government will bring in only a regime change.

Guruparan Kumaravadivel was touching on the difference between government and State in his press meet in Jaffna last week. He has also aptly raised the point that rather than a CoI that may end up with another report, what is more important is how to take it beyond for binding it with action from the UN.

As an urgently needed practical measure, Guruparan was calling for a transitional administration for the North and East under UN supervision, within a united framework of the island. He said, “We are not demanding anything controversial. We are only asking the measures for which there is precedence.” However, it was unwarranted for him to say that the transitional administration should be within a united country. A transitional administration is transitional administration for the concerned people to decide on the matter of unity or not.

The new generation in Tamil Nadu has to carefully peruse the discourse arising from this year’s UNHRC sessions. It is time to have a review on the US infiltrations that have been actively taking place since the 1950s, in every walk of life and mind-set. It has to be realised that without Tamils proving their geopolitical strength no justice is going to come.

In the meantime, one has to be equally vigilant about a section of the former Peking-wing articulators operating from the diaspora, who come out with US-bashing and Tamil ‘bourgeois’-bashing, but have no qualms about supporting Rajapaksa. There is another section that works like the ‘Deep Penetration Unit’ of the war times, in tandem with the diplomatic missions of Colombo or with agencies of Colombo-supporting Establishments. Infiltrating and hijacking the social and cultural organisations of Eezham Tamils is the agenda. Also take a note of the mushrooming publications that confine lessons-learning to the militant struggle of Tamils alone and do not speak on learning lessons about the ultimate culprits.
