British State complicity in genocide of Eezham Tamils explored in new report

Phil Miller, a researcher for Corporate Watch in London, who gave expert evidence on ‘British State complicity in genocide of the Tamil people’ at the Permanent Peoples’ Tribunal on Sri Lanka (Bremen Session), has brought out an updated report titled “Britain's Dirty War against the Tamil people - 1979–2009” published by the International Human Rights Association Bremen. “This report draws on original research conducted at the UK National Archives and from Freedom of Information requests, as well as pooling together disparate information that is available in the public domain,” Phill Miller says in the preface. Dr N. Malathy, a key member of NESoHR and author of ‘A Fleeting Moment in my Country’, who survived the genocidal onslaught on Vanni, introduces the report by Philip Miller to TamilNet readers.

There is a cost in bringing out the truths that are not already in the public domain. When the truth is against the interest of the powerful, such as the British government, it is difficult to find the resources needed to expose that truth. It is invariably those with an acute awareness of the need to bring out that truth who put in their own resources to do so. The report, “Britain’s Dirty War against the Tamil people” is such an effort by Phil Miller. It is published by the International Human Rights Association Bremen.
The report focuses on Britain’s role in the genocide of Eelam Tamils during the post-colonial period. Phil Miller has put together information collected from disparate sources such as declassified British documents, those obtained under the Freedom of Information Act, as well as what is available in the public domain such as books, reports, news reports etc. Each category of information requires efforts, to obtain as well as process them into usable facts. Even what is available in the public domain requires gathering and piecing together so that they establish a fact. Phil Miller has created a very readable set of evidence that is presented chronologically. That is not an easy task.

The extensive evidence presented in the report range from: covert operations during 1984-87 using ex-British military officers, overt training of Sri Lankan military and police from 1983 to this very day, extensive sale of arms to Sri Lanka during ceasefire, urging EU to proscribe LTTE during ceasefire and blocking UN Security Council action against Sri Lanka in 2009.

The evidence is presented in the report in three phases. The first from 1979-1989 titled “Tackling the Tamil problem” documents in addition to the extensive covert operations using ex-British military personnel as mercenaries, the training of Sri Lankan military and police officers and even advising the Indian forces that landed in the Tamil homeland in 1987. It names many of the British officials who were involved. During the next phase from 1990-2002, Britain’s role in training Sri Lankan military officers expands. The Sri Lankan Army Command and Staff College was setup during this phase with heavy involvement of British military officials some of whom were permanently stationed in Sri Lanka to work in this college. The last phase covers the period from 2002 to 2009 when, Britain was instrumental in getting the LTTE proscribed by the EU and it sold extensive list arms to Sri Lanka while the ceasefire was still in effect.

In the chapter on the second phase, the report also unearths the involvement of Britain in urging the Sri Lankan government to avoid a ceasefire with the LTTE following the 2001 devastating LTTE attack on the Bandaranaike airport. It documents the expert team of fifteen top retired British military officials sent to Sri Lanka after this attack to protect important hubs thus avoiding a ceasefire by the embattled Sri Lankan government.

The report contrasts the long list of British arms sales to Sri Lanka during the ceasefire period of 2003 to 2006 to that of the goods sent by a British Tamil activist Shanthan over the same period. The list of items sent by Shanthan included mostly computers, no military equipment was sent by him. Yet, he was sentenced for this in Britain in 2009.

This report is an expanded version of the evidence Phil Miller gave at the Permanent People’s Tribunal on Sri Lanka held in Bremen in December 2013. His evidence together with the evidence presented by Viraj Mendis on Britain’s role during colonial period nailed the verdict of Britain’s complicity in the genocide of Tamil people. The evidence given by Viraj Mendis will also be published on July 15 on the PPT Sri Lanka website (www.ptsrilanka.org).

When the Permanent People’s Tribunal on Sri Lanka passed the verdict of Britain’s complicity in the genocide of Tamils, there was a surprising reaction from some Tamil quarters. Some Tamils rejected the verdict and others wished that it was supressed. The situation is best understood by looking at a parallel more easily understood event. When a high caste group in India murdered a low caste young man who dared to rebel against some caste injustices there were many low caste people who refused to give evidence against the high caste group. If one examines the various reasons for this refusal, the Tamil rejection of Britian’s complicity will also start to make sense.

Exposure of the complicity of the powerful states in the Eelam Tamil genocide rather than its suppression ought to be the moral force that should be used to force these states to remedy the carnage they had caused and continue to cause. Phil Miller’s work is an important contribution towards this.

Observing that the Sri Lanka army “cannot be separated from the wider political culture of entrenched Sinhala nationalism and militarism in which it exists” and the LTTE “was not a typical insurgency and is better considered as a de facto quasi-state with institutions covering taxation, policing, judiciary and public services”, it is unwise to consider the SLA as a counterinsurgency force, argues Rob Pinney, researcher at the Department of War Studies, King’s College London. In a paper published on Small Wars Journal on 23 June, the Mr. Pinney further concludes that “failure to address the political grievances of the Tamil population is likely to imperil the prospect of a durable peace.” A Tamil analyst, however, alludes to genocidal nature of the unitary Sinhala state as the prime reason of its “failure” to provide a political solution.

Mr. Pinney’s paper “Can the Sri Lanka Army be described as a counterinsurgency force?” was published on Small Wars Journal on 23 June 2014.

Pinney bases his argument that the SLA is not a COIN force on four points – that the LTTE was not like other insurgencies but rather was a functioning de facto state, that the SLA adapted irregular techniques in its war on the LTTE making it a ‘hybrid warfare’ and not a typical COIN operation, that the SLA cannot be separated from the Sinhala-Buddhist state building project, and finally that there is a failure of the GoSL to provide a political solution to the Tamils.

The last point is derived from the classical COIN theoretical position that a military victory over an insurgency is incomplete without a political victory.

However, the GoSL is structurally incapable of providing a political solution to the Tamils because the unitary state itself is based on genocide of the Eezham Tamil nation, comments a Tamil analyst.

Further comments from the analyst follow:

While veterans in the global COIN field like experts David Kilcullen and Ahmed Hashim and British foreign policy analyst Paul Moorcraft have praised the ‘victory’ of Sri Lanka model of COIN, Mr. Pinney differs in his refusal to confer the status of a ‘counterinsurgency force’ to the Sri Lanka Army.

That the acceptance of the ‘Sri Lanka model’ as a credible and effective model of COIN by military quarters is not just a threat to world peace, but is also pernicious to the very nature of war studies has been pointed out by analysts earlier.

British military historian Liddell Hart defines strategy as the application of military means to fulfil the ends of policy of a state.

The policy of the Sri Lankan state, ever since its creation by the colonial powers, towards the Eezham Tamil nation has been one of genocide.

As a result, a reading of “war” or “counterinsurgency” by itself without taking into account this policy itself produces only a part of the picture.

World powers, despite being aware of this policy of the Sri Lankan state, fully equipped it militarily and theoretically in its war on the Tamil resistance, the result being the genocidal onslaught on Tamils in 2009.

For instance, Gordon Weiss, former UN spokesperson in Sri Lanka, was fully aware that the Sri Lankan military was using cluster bombs against the Tamils. He remained silent on the fact at that time, and after May 2009, wrote a book with the theme of ‘war crimes of both sides’.

While the nature of the internationally trained Lascarine military of Sri Lanka is recognized by the Tamil people as an occupying, genocidal army, many Tamil thinkers observe that their struggle for national liberation is still viewed under the COIN paradigm by world establishments. This only further contributes to the intransigence of the Sri Lankan state.

A South African delegation, comprising South Africa's Special Envoy to Sri Lanka and South Sudan, Deputy President Cyril Ramaphosa and Nomaindia Mfeketo, the deputy minister of South African International Relations and Cooperation, visited Jaffna on Tuesday and spent one hour with Northern Provincial Council (NPC) Chief Minister CV Wigneswaran. Addressing the press following his meeting with the South African delegation, Mr Wigneswaran said Mr Ramaphosa assured him that the 'South African involvement' would not be contradictory to the 'political initiatives' by New Delhi and to the Geneva-based war-crime process supported by the Western countries.

The meeting with Mr Wigneswaran comes after the visiting envoy had met Mr Sampanthan in Colombo.

"At first, we were wondering on the motive of their visit," Mr. Wigneswaran told the press.

Wigneswaran has been given the task of 'briefing' the public on the South African delegation's engagement with TNA by its Parliamentary Group leader Mr Sampanthan and the nominated parliamentarian MA Sumanthiran, informed TNA sources told TamilNet Tuesday.



After the Commonwealth Summit last year, Colombo had requested South Africa to assist with a truth and reconciliation process, Mr Wigneswaran was told by the visiting South African delegation.

“We asked the visiting South African delegation whether their engagement would not be contradictory to what India is trying to achieve and the war-crimes investigation process, which the Western countries have been favorable to. And the response was that South African process would be complementary to these processes,” Mr Wigneswaran told reporters.

Cyril Ramaphosa was appointed Special Envoy to Sri Lanka and South Sudan by South African President Jacob Zuma in February.

"We are going to listen to the Sri Lankans. We have already met them a few times in South Africa, but this time around we are going to go to Colombo and meet the government, the President of Sri Lanka and a number of other government ministers," South African media quoted him as saying before his visit.

"We will discuss with people in the community. We will also try to help the Sri Lankans with the Truth and Reconciliation process, their own constitutional reform and make sure Sri Lanka does indeed become a stable country where they will enjoy human rights,” he went further on record.

"Only time will tell whether Ramaphosa would get a lesson on the impossible nature of resolving the chronic national question of Eezham Tamils within the Sri Lankan unitary constitution or whether he would end up like Norway's failed peace-broker Erik Solheim, who is now confined to social media and authoring literature defending his failures in the past," a senior journalist in Jaffna commented after listening to Mr Wigneswaran.

"However, if this is brokering on behalf of the Unitary State of Sri Lanka, the process wouldn't last that long," he added.

The occupying Sri Lankan military, which recently interfered in cancelling the workshops organised for the journalists from the North and East, has now sent a threatening circular to all Non Governmental Organizations instructing them to put an immediate end to the practices of “press conferences, training for journalists and dissemination of press releases which is beyond their mandate.” Colombo’s genocidal military, which is preoccupied with sustaining the gagged condition in the occupied country of Eezham Tamils, is strongly opposed to any attempt to empower the journalists in the North and East. The SL military is also targeting to destablize the civil and political groups that help people to democratically mobilise against the structural genocide.

“It has been revealed that certain Non Governmental Organizations conduct press conferences, workshops, training for journalists and dissemination of press releases which is beyond their mandate. We reiterate that all Non Governmental Organizations should prevent from such unauthorised activities with immediate effect,” said the circular issued by D.M.S Dissanayake, the Director/Registrar at the SL Ministry of Defence and Urban Development, which is run by SL presidential sibling Gotabhaya Rajapaksa.

Transparency International Sri Lanka (TISL) organised a series of workshops on the topic of investigative journalism in May this year. The SL military intelligence directly intervened in suspending a workshop in Polonnaruwa on 22 May and on 06 June the SL military intelligence organised a protest against the workshop at Negombo.

SL presidential sibling Gotabhaya Rajapaksa, a US citizen who is regularly in touch with the US military Establishment, is opposed to certain NGO programmes being funded by the USAID agency since he views these programmes as strengthening the ‘Regime Change’ line of thought running against the ‘military-to-military’ nexus between the Pentagon and Colombo's genocidal military.

Following an urgent hearing of an application from refugee advocates in Australia, the High Court in Austrlia has refused to allow the Australian Government to hand over the 153 Eezham Tamil refugees to Sri Lankan authorities, delivering an interim injunction until Tuesday afternoon, news reports from Australia said Monday. The latest development comes following a controversial move by the Australian authorities that handed over 41 asylum seekers back to the Sri Lankan military after the so-called processing of their asylum applications at the sea.

Lawyer George Newhouse, representing 48 refugees of the boat has told Guardian Australia that Justice Crennan has granted an injunction until 4pm Tuesday.

The 153 Eezham Tamil refugees, who had set off from the coast of Tamil Nadu, have been detained on board a Customs ship after their boat was intercepted off Christmas Island a few days ago.

Several persons among the 153 asylum seekers had fled the island after being subjected to torture and repeated threat at the hands of the occupying Sri Lankan military.

The interim injunction will be in place until the High Court will be hearing the case, news reports from Australia further said.

In the meantime, 53 law scholars from 17 Australian universities have demanded a legal explanation from the Austrlian Government on the controversial move of detention and handing over asylum seekers at mid-sea.

“Holding asylum seekers on boats in this manner also amounts to incommunicado detention without judicial scrutiny,“ they said in a statement.

The move willl breach Australia's obligations under international refugee and human rights law, including the 1951 Refugees Convention, 1948 Universal Declaration on Human Rights, and the 1966 International Covenant on Civil and Political Rights, they further said.

In the meantime, Tamil rights activists in the island alleged that the Sri Lankan military intelligence was behind the boat with 41 ‘asylum seekers’. Strangely, 37 of them were Sinhalese and all of them were men. The move was intended to give an opening to the Australian military to deport the asylum seekers at mid sea, the Tamil activists said alleging a ‘military-to-military’ relationship between the Australian and the Sri Lankan military.

Australia's Immigration Minister Scott Morrison has issued a statement on the handover over 41 people to the Sri Lankan military. In the statement he said: “Just one of the 41 people on board was assessed as possibly having a case for asylum, and was given the option of being transferred to Australia's detention camps in the South Pacific island nations of Nauru or Papua New Guinea for further processing.” The asylum seeker opted instead to return to Sri Lanka, Morrison further said in his statement.

District and divisional secretaries in Vavuniyaa district have been receiving increasing number of complaints in recent times on alleged land appropriation by the occupying Sri Lankan military in the district, news sources in Vavuniyaa said. Tamil National Alliance (TNA) parliamentarian from Vavuniyaa Mr Sivasakthi Ananthan confirmed the reports stating that even the AGA of Vavuniyaa division, Ms S. Karnan was producing a list detailing the complaints of land grab by the SL military amounting to 398 acres in recent times.

240 acres of lands have been seized for SL Army and Air Force bases in recent weeks in Vavuniyaa.

A detailed report with the recent complaints of genocidal land grab needs to be prepared before the next District Development Council meeting in Vavuniyaa, Mr Sivasakthi Ananthan said adding that there have more than 30 reports of lands being seized by the SL military and police in recent weeks alone.

While an occupying military is appropriating lands of Eezham Tamils in Ampaa’rai district in favour of an ethnic group, another group is buying lands deploying large sums of money with the backing of ministers in the ruling alliance. Eezham Tamils are also side-lined in the public sector employment, said All Ceylon Workers Association leader S. Loganathan on Saturday. The conduct of certain ministers aligned with the ruling Colombo government is sabotaging the emerging understanding between the Tamils and Muslims, he said.

63 public sector posts at Kalmunai Municipal Council have been allocated completely to a single community. Tamils have been totally side-lined, Mr Loganathan said.

“Where is the stated policy of employing workers to public sector according to the prevailing ethnic ratio in the concerned locations,” he questioned.

Even the few Tamil civil servants serving in the top positions in Ampaa’rai district are being transferred from the district to other districts, he said.

The Tamil politicians collaborating with the ruling government have also failed to address this serious issue, he said.

As a trade union, All Ceylon Workers Association is obliged to voice against the injustice, Mr Loganathan said.

At the same time, lands belonging to Eezham Tamils are being taken over with political might in Thiraaykkea’ni in Addaa’laich-cheanai division, Addap-pa’l’lam in Ninthavoor, Maa’nikka-madu in I’rakkaamam division and in the Tamil villages in Naavithan-ve’li division of Ampaa'rai district, Tamil activists complain.

Even as apprehensions are rising regarding reports that the Australian government has handed over 153 Tamil refugees to the Sri Lanka Navy, Australian Prime Minister Tony Abbott has praised Sri Lanka, the island where a structural, protracted genocide is happening against the Eezham Tamil nation, as a "society at peace". Speaking to 3AW on Thursday, Abbott had further said that "there has been a lot of progress when it comes to human rights and the rule of law in Sri Lanka.'' However, the Tamil Refugee Council has said that at least 11 of the fleeing refugees had been tortured by the GoSL forces earlier. The Australian government, which had no concerns for the thousands of Eezham Tamils who were slaughtered in 2009 and ignored the plight of more than 146,000 Eezham Tamils reported missing, is determined to return the 153 refugees despite widespread criticism against the move.

There were at least 37 children in the boat carrying 153 Eezham Tamil refugees and one of them is three months old and severely ill, independent media reports said.

Abbott, who should be well aware of the figures of missing people as documented by the Bishop of Mannaar, not to mention cases of ongoing torture and rape as documented even by organizations within the Western establishments, has chosen to praise the genocidal Sri Lankan state instead, Tamil activists in the island complain.

Australia was supporting the US-led alliance that abetted the genocidal Sri Lankan State to conclude the war in a massive onslaught in May 2009. Apart from the thousands who were killed and wounded, more than 146,000 still remain unaccounted for.

Australia, like the other players locked in the geopolitical game, has not cared about those who have been reported missing. Now, the same country is becoming directly responsible for the disappearances, torture and the slaying of the fleeing Eezham Tamils in the hands of the genocidal Sri Lankan State.

When the Australian Government is not prepared to care for the disappearance of 146,000 Tamils, how could one expect it to care about 153 Tamils is the question asked by Tamils who are at the receiving end.

''It is absolutely wrong for Australia to return people seeking asylum to the countries in which they were being persecuted. It is wrong. It is shameful," said Australia's Greens leader Christine Milne.

Labor's immigration spokesman Richard Marles has also gone on record stating that it would be a disgrace if asylum seekers were handed over to Sri Lanka, according to The Sydney Morning Herald.

Fr Maurizo Pettena, the director of the Australian Catholic Migrant and Refugee Office, said the underlying discrimination in the island of Sri Lanka remains a violent reality for many of the Tamil people even though the war had come to an end.

"At a time when we are witnessing some of the greatest humanitarian challenges and highest numbers of displaced people around the world, it is crucial Australia remains a country of refuge for those suffering from persecution," he said in a statement issued by Australian Catholic Bishops and the Jesuit Refugee Refuge Service Australia (JRS).

Following the conduct of the Australian government, the plight of Eezham Tamil refugees in Tamil Nadu State has also gained attention as many of the refugees in the Indian camps were also fleeing towards Australia. The Australian government also waged a campaign targeting the Eezham Tamil refugees in Tamil Nadu that they would be handed over to Sri Lanka if they were caught in the seas.

Under India's Foreigners Act 1946 and Citizenship of 1955, all non-citizens who enter India without visas are seen as illegal immigrants. Even the possession of a UNHCR refugee certificate does not bring any protection from detention.

“Unlike India however Australia is not only a signatory to the UN Convention on Refugees but helped write the Convention. Among all those who signed the Convention, Australia is currently the only nation that denies people asylum based on their mode of arrival,” the JRS statement said.

"Seeking asylum is not illegal and remains a human right with the Refugee Convention clearly stating that asylum seekers should not be penalised for their mode of arrival or lack of documentation," Oliver White of JRS further said.

Human Rights watchdogs around the globe including the United Nations' refugee agency have expressed "profound concern" about reports that refugees seeking Australia's protection are being intercepted and processed at sea.

“Tamils living around the globe should also learn a lesson on the so-called effectiveness of the campaigns being waged by the global human rights outfits on the matter,” an activist in the island said. “When even Australia is not prepared to listen to them, how could a genocidal State like Sri Lanka listen to their campaigns,” the activist questioned adding: “Tamils should pay more attention towards waging ‘system-changing’ political struggle than getting into the hands of the ‘regime-changing’ outfits.”
